Background:

  • The Executive Order builds on previous orders (notably Executive Order 14,066 and 14,024) responding to Russian actions in Ukraine.
  • The U.S. continues to view the Russian Federation’s activities as an “unusual and extraordinary threat” to national security and foreign policy.

Tariffs on India:

  • The U.S. finds that India is directly or indirectly importing Russian oil.
  • An additional 25% ad valorem tariff is imposed on Indian imports, effective 21 days after the order (with some exceptions for goods already in transit).
  • The tariff is in addition to other duties, unless certain exceptions apply.

Scope and Stacking:

  • The new tariff stacks with other tariffs unless the goods are already subject to specific trade actions or exceptions.
  • Some goods are exempted, as detailed in referenced annexes and statutes.

Modification Authority:

  • The President reserves the right to modify the order in response to new information, foreign retaliation, or changes in Russian or foreign government behavior.

Monitoring and Recommendations:

  • The Secretary of Commerce, in coordination with other agencies, will monitor other countries’ imports of Russian oil and recommend further action if needed.
  • The Secretary of State will regularly consult on the emergency and recommend additional actions if the order is not effective.

Delegation:

  • Various cabinet secretaries and agencies are authorized to take necessary actions to implement the order, including regulatory changes and enforcement.

Definitions:

    • Russian Federation oil” is defined broadly to include crude oil or petroleum products extracted, refined, or exported from Russia.
    • “Indirectly importing” includes purchases through intermediaries or third countries if the oil can be traced to Russia.

  • Severability and General Provisions:

    • If any part of the order is found invalid, the rest remains in effect.
    • The order does not create enforceable rights for any party.

    Signature:

    • Signed by President Donald J. Trump at the White House, August 6, 2025.

    Notable Quotes:

    • “The actions and policies of the Government of the Russian Federation continue to pose an unusual and extraordinary threat to the national security and foreign policy of the United States.”
    • “I determine that it is necessary and appropriate to impose an additional ad valorem duty on imports of articles of India, which is directly or indirectly importing Russian Federation oil.”
