Virginia Giuffre filed a motion requesting the court’s permission to proceed with alternate service of subpoenas because several key witnesses were evading standard service attempts. These subpoenas were crucial to her defamation suit against Ghislaine Maxwell, as they sought deposition testimony from individuals who could corroborate her claims that Maxwell was involved in recruiting young girls for Jeffrey Epstein. Giuffre’s legal team argued that these testimonies were essential and timely—fact discovery was nearing its deadline—and witnesses had either canceled scheduled depositions or actively avoided being served. In one notable instance, it required a motion just to get Epstein’s attorney to accept service on his behalf.

By granting alternate service, the court would enable Giuffre to move forward with depositions of critical figures, including Nadia Marcinkova and Sarah Kellen, whose testimonies were deemed vital for showing Maxwell’s central role in Epstein’s trafficking network. The motion emphasized that without these depositions, Giuffre’s opportunity to substantiate her defamation claims would be severely impeded.
