This week we're exploring the complex relationship between land use regulation and constitutional rights in the United States. It examines the historical evolution of zoning, starting with the City of Euclid v. Ambler Realty Co. case of 1926, which upheld the use of zoning to separate incompatible land uses. The text then goes into the nuances of zoning, covering topics such as nonconforming uses, vested rights, and the challenges posed by “contract zoning”. Our source also highlights the significance of the Mount Laurel doctrine, which mandates that municipalities must provide opportunities for affordable housing. This doctrine emerged as a response to concerns about exclusionary zoning practices that disproportionately impacted lower-income residents.
