In late October 2021, Prince Andrew’s legal team filed a motion in a New York federal court asking Judge Lewis Kaplan to dismiss the sexual—assault lawsuit brought by Virginia Giuffre (formerly Roberts), who alleged she was trafficked by Jeffrey Epstein to have sex with the prince when she was a minor. The Duke’s lawyers argued that the 2009 settlement agreement between Epstein and Giuffre, which included a broad release of “any other person or entity who could have been included as a potential defendant,” barred her from suing Andrew. They claimed the agreement demonstrably exempted him from liability, characterizing the lawsuit as a “payday” effort on Giuffre’s part.

On January 12, 2022, Judge Kaplan rejected the motion to dismiss in its entirety. He found the 2009 settlement to be ambiguous, stating it failed to “clearly and unambiguously” show intent to release Prince Andrew from liability; the term “potential defendant” was not sufficiently precise. The judge also ruled that Giuffre’s complaint contained sufficiently specific factual allegations to survive dismissal. This decision allowed the civil case to proceed toward discovery.
