The Court was asked to consider the circumstances in which third parties could make representations where a crown court made a determination of a defendant’s interest at the confiscation stage (s160A, Proceeds of Crime Act (‘PoCA’) 2002). Though an appeal on a provision which relates to PoCA powers in Northern Ireland (s160A), it has a wider impact given the operation of an equivalent provision in England and Wales (s10A, PoCA 2002).
